Under this law, a vehicle may qualify as a "lemon" if it has a defect or condition that substantially impairs its use, market value, or safety, and the manufacturer or its authorized dealer has been unable to resolve the issue after a reasonable effort.

Missouri law presumes that a reasonable number of repair attempts has been made if the same defect has been brought in for repair four or more times and the issue persists, or the vehicle has been out of service for a cumulative total of 30 or more business days due to warranty repairs.

If those thresholds are met, the manufacturer is required to either replace the vehicle with a comparable new one or refund the full purchase price, minus a reasonable allowance for the consumer's use of the vehicle.

What Does the Lemon Law Cover?

Missouri's Lemon Law applies specifically to new motor vehicles that are still within the manufacturer's original express warranty or within one year of the original delivery date, whichever comes first. This includes cars, trucks, SUVs, and vans purchased or lease-purchased from a franchised dealer, as long as the vehicle is used primarily for personal, family, or household purposes.

The law does not cover commercial vehicles, off-road vehicles, mopeds, or the living-quarters portion of recreational vehicles.
